|
The
unfunded state mandates provision of the Maine Constitution has been found by
the Office of the Maine Attorney General not to apply to Maine's waste
discharge licensing program.
Accordingly, state laws or regulations governing waste discharge
licensees cannot be considered to impose mandates on local units of
government. Therefore, the language
proposed in the bill would not limit the Department of Environmental
Protection from imposing any new requirements by rule and there would be no
fiscal impact to its passage. |
