An Act To Facilitate the Construction and Operation of Private Prisons by Authorizing the Transport of Prisoners out of State
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 34-A MRSA §1403, sub-§12 is enacted to read:
12. Transport of prisoner out of State. The commissioner may allow the transport of a prisoner out of the State for any purpose that the commissioner determines necessary and appropriate, including the transfer of a prisoner to a public or private correctional facility. For purposes of this subsection, "out of the State" means to any state other than Maine and any territory or possession of the United States, but does not include a foreign country.
