An Act To Require Random Drug Testing for MaineCare Recipients
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 22 MRSA §3174-QQ is enacted to read:
§ 3174-QQ. Eligibility exclusion
A person who tests positive for use of illegal drugs may not receive benefits under this chapter. The department shall adopt routine technical rules pursuant to Title 5, chapter 375, subchapter 2-A to establish random drug testing procedures and to suspend Medicaid benefits for persons who test positive for use of illegal drugs until a subsequent test by the person is negative.

This bill provides that a person who tests positive for use of illegal drugs may not receive benefits under the Medicaid program until the person tests negative.
