An Act To Provide for the Appointment of Division Directors in the Department of Environmental Protection

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 5 MRSA §938, sub-§1-A,  as amended by PL 2005, c. 519, Pt. K, §1, is further amended to read:

1-A. Major policy-influencing positions.   The following positions are major policy-influencing positions within the Department of Environmental Protection. Notwithstanding any other provision of law, these positions and their successor positions are subject to this chapter:
A. Deputy Commissioner;
C. Director, Policy Development and Implementation;
D. Director, Education and Outreach;
E. Director, Innovation and Assistance;
F. Director, Bureau of Air Quality Control;
G. Director, Bureau of Remediation and Waste Management; and
H. Director, Bureau of Land and Water Quality . ;
I Director, Division of Field Services in the Bureau of Air Quality;
J Director, Division of Program Planning in the Bureau of Air Quality;
K Director, Division of Licensing and Enforcement in the Bureau of Air Quality;
L Climate Change Coordinator in the Bureau of Air Quality;
M Director, Division of Land Resource Regulation in the Bureau of Land and Water Quality;
N Director, Division of Environmental Assessment in the Bureau of Land and Water Quality;
O Director, Division of Water Quality Management in the Bureau of Land and Water Quality;
P Director, Division of Watershed Management in the Bureau of Land and Water Quality;
Q Director, Division of Solid Waste Management in the Bureau of Remediation and Waste Management;
R Director, Division of Response Services in the Bureau of Remediation and Waste Management;
S Director, Division of Technical Services in the Bureau of Remediation and Waste Management;
T Director, Division of Oil and Hazardous Waste Facility Regulation in the Bureau of Remediation and Waste Management; and
U Director, Division of Remediation in the Bureau of Remediation and Waste Management.

SUMMARY

This bill adds division directors within bureaus of the Department of Environmental Protection to the list of major policy-influencing positions. The effect of this change is that these positions will no longer be classified service positions within an employee bargaining unit but will become unclassified service positions appointed by the Commissioner of Environmental Protection.
