An Act To Improve the Access of Beer and Wine Licensees to Agency Liquor Store Licenses
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 28-A MRSA §453-A, sub-§9 is enacted to read:
9. Exception for malt liquor and wine off-premise retail licensees. Notwithstanding subsection 5, the bureau may not deny a license under this section to an off-premise retail licensee who is licensed to sell malt liquor and wine under section 1201 solely because of the proximity of the licensee to an existing agency liquor store or the impact of the proposed license on existing agency liquor store licensees.

This bill provides that the Department of Public Safety, bureau of liquor enforcement may not deny an agency liquor store license to an off-premise retail licensee who is licensed to sell malt liquor and wine solely because of proximity to an existing agency liquor store or the impact of the proposed license on existing agency liquor store licensees.
