An Act To Provide a More Comprehensive Ban on the Possession of Synthetic Hallucinogenic Drugs
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 17-A MRSA §1101, sub-§16-A, ¶¶G and H, as enacted by PL 2011, c. 465, §5, are amended to read:
G. Napthylpyrovalerone, NRG-1; or
H. Beta-keto-N-methylbenzodioxolylpropylamine . ;
Sec. 2. 17-A MRSA §1101, sub-§16-A, ¶¶I and J are enacted to read:
I. 2, 5 - dimethoxy-4-ethylphenethylamine; and
J. Any nonorganic, chemically synthesized drug identified by rule adopted by the Commissioner of Public Safety pursuant to Title 25, section 2956, subsection 4 as being similar in effect to those identified in paragraphs A to I.
Sec. 3. 25 MRSA §2956, sub-§4 is enacted to read:
4. Synthetic hallucinogenic drugs. The commissioner may with advice of the board adopt rules identifying synthetic hallucinogenic drugs as defined in Title 17-A, section 1101, subsection 16-A. Rules adopted pursuant to this subsection are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

This bill expands the category of illegal synthetic hallucinogenic drugs by permitting the Commissioner of Public Safety to identify by rule drugs similar in effect to those currently specified in statute in recognition of the fact that the development of synthetic hallucinogenic drugs is expanding rapidly and flexibility is needed to identify dangerous drugs in an expeditious manner.
