An Act To Impose a Penalty for Making False Claims Regarding Affiliation with a Federally Recognized Tribe
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 17-A MRSA §909 is enacted to read:
§ 909. Fraudulent claim of affiliation with a federally recognized tribe
1. A person is guilty of fraudulent claim of affiliation with a federally recognized tribe if the person:
A. Knowingly claims falsely to be affiliated with a federally recognized tribe;
B. Has the intent to obtain by making the claim under paragraph A something of value to which the person is not entitled; and
C. Obtains by making the claim under paragraph A something of value to which the person is not entitled.
2. Fraudulent claim of affiliation with a federally recognized tribe is a Class E crime.

This bill creates the crime of fraudulent claim of affiliation with a federally recognized tribe for when a person knowingly claims falsely to be affiliated with a federally recognized tribe with the intent to obtain, and does obtain, something of value to which the person is not entitled.
