Amend the bill by striking out the title and substituting the following:

‘An Act To Permit the Use of Electronic and Mechanical Dispensers for Games of Chance Conducted by Veterans' Organizations’

Amend the bill by striking out everything after the enacting clause and before the summary and inserting the following:

Sec. 1. 17 MRSA §1835, sub-§8  is enacted to read:

8 Dispensers for sealed tickets and similar games.   A licensee that is a qualified veterans’ organization may operate a dispenser to sell lucky seven or other similar sealed tickets. The element of chance must be provided by the ticket and not by the dispenser.

As used in this subsection, unless the context otherwise indicates, the following terms have the following meanings.

A "Dispenser" means an electronic or mechanical device that, upon insertion of money, credit or something of value, dispenses printed lucky seven or other similar sealed tickets. A dispenser may include a function to electronically read a dispensed ticket and determine whether the ticket is a winning ticket.
B "Qualified veterans' organization" means a veterans' organization that:

(1) Holds a federal tax exemption under the United States Internal Revenue Code, Section 501(c)(19); and

(2) As of September 1, 2012, has owned or leased for a minimum of 2 consecutive years the building that serves as the primary location of the veterans' organization's operations and where it conducts licensed games of chance.

The Chief of the State Police may adopt routine technical rules, as defined in Title 5, chapter 375, subchapter 2-A, to implement the provisions of this subsection and facilitate the use of dispensers.

This amendment replaces the bill and is the minority report of the committee. The amendment permits veterans' organizations licensed to conduct games of chance to operate electronic and mechanical ticket dispensers. These machines dispense lucky seven or similar sealed tickets and may include a function that electronically reads a dispensed ticket to determine if it is a winning ticket. The amendment specifies that the element of chance is not determined by the machine but by the ticket itself.
