Resolve, To Create a Mitigation Fund for Damage Caused by Unauthorized All-terrain Vehicle Use on Private Land
Sec. 1. Mitigation fund. Resolved: That the Department of Conservation and the Department of Inland Fisheries and Wildlife, referred to in this resolve as "the departments," shall jointly develop recommendations to establish and fund a mitigation fund for damage caused to private land by unauthorized all-terrain vehicle use. The departments shall develop guidelines for the operation of the mitigation fund, including recommendations for an ongoing source of money for the mitigation fund. In developing recommendations for a source of money, the departments shall consider, but are not limited to, dedicating a portion of all-terrain vehicle registration fees; and be it further
Sec. 2. Report. Resolved: That the departments shall report their recommendations and any necessary implementing legislation to the Joint Standing Committee on Inland Fisheries and Wildlife by January 1, 2012. The joint standing committee is authorized to report out legislation to the Second Regular Session of the 125th Legislature.
