An Act To Modify the Standard of Proof for Traffic Infractions
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 29-A MRSA §103, sub-§4 is enacted to read:
4. Standard of proof. The burden of proof that a traffic infraction has occurred is on the State and must be established by a standard of clear and convincing evidence.
