An Act To Allow the Burning of Certain Agricultural Products in Outdoor Wood Boilers
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 38 MRSA §610-B, last ¶, as enacted by PL 2007, c. 442, §2, is further amended to read:
The Department of Environmental Protection shall adopt rules to implement this section. Notwithstanding section 592-A, the rules must include a definition of "nuisance condition" specifically relating to the operation of outdoor wood boilers. The rules may not prohibit the burning of hay bales and cornstalks in an outdoor wood boiler. Rules adopted pursuant to this section are major substantive rules as defined in Title 5, chapter 375, subchapter 2-A.
