An Act Pertaining to Railroad Crossing Fees
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 23 MRSA §7229-A is enacted to read:
§ 7229-A. Private crossings; certain costs prohibited
A railroad may not require a person who owns or has a right of way over a private way that is crossed by a railroad crossing to pay a fee or maintain insurance in exchange for the right to pass over the railroad crossing.
SUMMARY
This bill prohibits a railroad from charging a fee from or requiring insurance of a person who owns or has a right of way to pass over a railroad crossing.
