Amend the bill by inserting after section 2 the following:
‘Sec. 3. Notification to individuals by person initiating pesticide application. The Department of Agriculture, Food and Rural Resources, Board of Pesticides Control shall amend Rule Chapter 28, Section 2, subsection D to require the landowner, lessee or other legal occupant of property who initiates a pesticide application to provide notification of the application to a person entitled to receive notification of the application.
Notwithstanding the Maine Revised Statutes, Title 7, section 610, subsection 6, paragraph B, the amendment to Rule Chapter 28 under this section is routine technical rulemaking as defined in Title 5, chapter 375, subchapter 2-A and must be adopted and in effect no later than January 1, 2012.’
Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.
SUMMARY
Under the current rules of the Department of Agriculture, Food and Rural Resources, Board of Pesticides Control, commercial pesticide applicators are required to notify an individual listed on the Maine Pesticide Notification Registry when performing an outdoor, nonagricultural pesticide application.
This amendment requires the board to amend its rules to require, instead of the commercial applicator, the landowner, lessee or other legal occupant of property who initiates a pesticide application to provide notification of the pesticide application.
