An Act To Exempt Seasonally Restricted Cottages from the Newly Adopted Maine Uniform Building and Energy Code
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 10 MRSA §9724, sub-§4, as enacted by PL 2007, c. 699, §6, is amended to read:
4. Exception. This section does not prohibit the adoption or enforcement of an ordinance of any political subdivision that sets forth provisions for local enforcement of building codes. The requirements of the Maine Uniform Building and Energy Code do not apply to:
A. Log homes or manufactured housing as defined in chapter 951; or
B. Post and beam or timber frame construction . ; or
C. Seasonally restricted cottages. For purposes of this paragraph, "seasonally restricted cottage" means a one-story building containing a single unit made up of a room or group of rooms containing facilities for eating, sleeping, bathing and cooking and that is not occupied and does not have water service from November 1st to April 30th.
