An Act To Encourage Clean Fuel Vehicle Economic and Infrastructure Development by Extending the Tax Credit
Emergency preamble. Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and
Whereas, the law providing a tax credit for clean fuel vehicle economic and infrastructure development does not apply after January 1, 2009; and
Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,
Sec. 1. 36 MRSA §5219-P, first ¶, as amended by PL 2005, c. 519, Pt. PPP, §2, is further amended to read:
This section is effective for tax years beginning on or after January 1, 1999 and is repealed for tax years ending on or after January 1, 2009 2013.
Sec. 2. Application. This legislation applies retroactively to tax years beginning on or after January 1, 2009 and before December 31, 2012.
Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.
SUMMARY
This bill extends the income tax credit for clean fuel vehicle economic and infrastructure development, which expired January 1, 2009, to 2012.
