An Act To Lower the Cost of State Government in the Departments under the Purview of the Joint Standing Committee on Natural Resources
Sec. 1. 5 MRSA §13105, sub-§2, ¶C, as amended by PL 2005, c. 19, §2, is further amended to read:
Sec. 2. 5 MRSA §13105, sub-§2, ¶D, as enacted by PL 2003, c. 673, Pt. M, §8, is amended to read:
Sec. 3. 5 MRSA §13105, sub-§2, ¶E is enacted to read:
(1) Energy efficiency and carbon reduction;
(2) Toxics and hazardous waste reduction;
(3) Developing environmental leader programs and encouraging technical assistance and mentoring with environmental leaders;
(4) Encouraging environmentally preferable purchasing;
(5) Piloting innovative environmental compliance outreach;
(6) Facilitating the implementation of environmental management systems through site visits and other assistance to ensure a good facility fit;
(7) Developing multimedia compliance models including outreach material, checklists for site visits and pollution prevention guidance and materials;
(8) Providing multimedia process energy and environmental mapping and other assistance as needed;
(9) Coordinating with various state media bureaus to incorporate developing regulatory policies, rules and legislation;
(10) Using compliance incentive policies to ensure compliance and pollution prevention assistance to small businesses; and
(11) Coordinating assistance efforts with other state agencies as needed.
Sec. 4. Transfer of duties. The Commissioner of Environmental Protection and the Commissioner of Economic and Community Development shall coordinate to ensure that the duties, functions and responsibilities of the Department of Environmental Protection, Office of Innovation and Assistance are transferred in a timely manner to the Department of Economic and Community Development, Office of Innovation. The Department of Economic and Community Development, Office of Innovation shall assume the duties, functions and responsibilities transferred to it in this Act within existing budgeted resources.
Sec. 5. Appropriations and allocations. The following appropriations and allocations are made.

SUMMARY
This bill eliminates the Department of Environmental Protection, Office of Innovation and Assistance and transfers the duties of that office to the Department of Economic and Community Development, Office of Innovation. This bill also eliminates funding for a total of 7 positions within the Department of Environmental Protection, 5 of which are associated with the Office of Innovation and Assistance and 2 whose duties include serving as legislative liaisons for the department.
