Amend the bill by striking out the title and substituting the following:

‘An Act To Permit Personal Watercraft on Lake State George in Liberty and To Increase the Minimum Penalties for Violations of Certain Laws Governing the Operation of Watercraft’

Amend the bill by inserting before section 1 the following:

Sec. 1. 12 MRSA §13068-A, sub-§2, ¶A,  as enacted by PL 2003, c. 655, Pt. B, §380 and affected by §422, is amended to read:

A. A person violates this subsection if that person owns a watercraft and negligently permits another person to operate that watercraft in violation of this chapter.

(1) A person who violates this paragraph commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

(2) A person who violates this paragraph after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.

Sec. 2. 12 MRSA §13068-A, sub-§8, ¶B,  as enacted by PL 2003, c. 655, Pt. B, §380 and affected by §422, is amended to read:

B. The following penalties apply to violations of this subsection.

(1) A person who violates this subsection commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

(2) A person who violates this subsection after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.

Sec. 3. 12 MRSA §13068-A, sub-§9, ¶A,  as enacted by PL 2003, c. 655, Pt. B, §380 and affected by §422, is amended to read:

A. A person who violates this subsection commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

Sec. 4. 12 MRSA §13068-A, sub-§13, ¶C,  as enacted by PL 2003, c. 655, Pt. B, §380 and affected by §422, is amended to read:

C. The following penalties apply to violations of this subsection.

(1) A person who violates this subsection commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

(2) A person who violates this subsection after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.

Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

This amendment is a minority report. It changes the fine structure for certain violations of watercraft operation laws from fines of not less than $100 or more than $500 to a minimum fine of $500.
