Amend the bill by striking out the title and substituting the following:
‘An Act To Amend the Laws Governing Unclaimed Deposits’
Amend the bill by striking out all of the emergency clause.
Amend the bill by striking out everything after the enacting clause and before the summary and inserting the following:
‘Sec. 1. 32 MRSA §1866-E, first ¶, as enacted by PL 2003, c. 499, §8, is amended to read:
The provisions of this section apply only to those beverage containers that are not subject to a commingling agreement pursuant to section 1866D and do not apply to wine distributors that are not participants in commingling agreements and that have wine distributing facilities in this State.’
summary
This amendment is the minority report of the committee and replaces the bill with a provision that exempts wine distributors that are not participants in commingling agreements and that have wine distributing facilities in this State from the laws governing unclaimed deposits for beverage containers. This amendment also removes the emergency preamble and the emergency clause.
