An Act To Require the Department of Education To Calculate Subsidy on the Basis of Membership in a Regional School Unit or an Alternative Organizational Structure and as if the School Administrative Unit Had Not Reorganized as of 2009
Emergency preamble. Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and
Whereas, this legislation needs to take effect before the expiration of the 90-day period in order to protect school administrative units from certain losses in school subsidy; and
Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,
Sec. 1. 20-A MRSA §1481-A, sub-§4 is enacted to read:
Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.

This bill requires the Department of Education to calculate the subsidy a school administrative unit would receive as part of a regional school unit or an alternative organizational structure and as if the school administrative unit had not reorganized pursuant to the Maine Revised Statutes, Title 20A, chapter 103A. The department shall pay the larger subsidy amount to the regional school unit or alternative organizational structure of which that school administrative unit is a member.
