Amend the bill by striking out all of the emergency preamble (page 1, lines 1 to 10 in L.D.).
Amend the bill in section 1 in §1653 by striking out all of the indented paragraph (page 1, lines 15 to 19 in L.D.) and inserting the following:
For each biennium, 3.75% of gross Highway Fund revenues, as determined based upon the most recent revenue forecast developed by the Revenue Forecasting Committee, established in Title 5, section 1710-E, must be allocated to the Department of Transportation Highway and Bridge Light Capital program for maintenance surface treatment. This paragraph is repealed June 30, 2014.’
Amend the bill by inserting after section 1 the following:
‘Sec. 2. Effective date. This Act takes effect July 1, 2011.’
Amend the bill by striking out all of the emergency clause (page 1, lines 20 to 21 in L.D.).

This amendment, which is the minority report of the committee, directs that 3.75%, instead of 7.5% in the bill, of gross Highway Fund revenues for each biennium must be allocated to the Department of Transportation Highway and Bridge Light Capital program for maintenance surface treatment. The amendment repeals this provision June 30, 2014. The amendment removes the emergency preamble and emergency clause of the bill and changes the effective date to July 1, 2011.
