Amend the bill by striking out all of section 1.
Amend the bill in section 2 in subsection 1B in paragraph E by striking out all of subparagraphs (1) and (2) (page 1, lines 28 to 33 in L.D.) and inserting the following:
‘ (1) The commissioner originally issued a license on or before September 1, 1989 for operation of the landfill and found that the landfill met the design requirements and environmental protection standards at the time of licensing; and
’ (2) The commissioner has since determined that the landfill or portion of the landfill must be closed based on the finding that the landfill is contaminating groundwater and that corrective actions have not been successful.
Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

The amendment strikes the provision in the bill that allows licensed municipal landfills to use reduced closure procedures. It also makes the State's cost-share program for municipal landfill closure applicable to municipal landfills that were originally licensed on or before September 1, 1989 and contingent on a finding that the landfill is contaminating groundwater and that corrective actions have not been successful.
