An Act To Amend the Unemployment Compensation Laws Regarding Vacation Pay
Emergency preamble. Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and
Whereas, this legislation needs to take effect before the expiration of the 90-day period in order to provide the workers of this State unemployment compensation benefits as soon as possible; and
Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,
Sec. 1. 26 MRSA §1193, sub-§5, ¶A, as repealed and replaced by PL 1985, c. 506, Pt. A, §51, is amended to read:
Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.
summary
Under current law, an individual is disqualified from receiving unemployment compensation benefits for any week in which the individual receives, is entitled to receive or has received remuneration in the form of vacation pay. This bill removes that restriction.
