An Act To Prevent the Spread of Invasive Plants and Protect Maine's Lakes

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 12 MRSA §12505, sub-§3-A  is enacted to read:

3-A Invasive aquatic plant infestation.   The commissioner may not issue a permit under this section to conduct a bass tournament on a water body that has a confirmed infestation of an invasive aquatic plant. For purposes of this subsection, "invasive aquatic plant" has the same meaning as in Title 38, section 410-N, subsection 1, paragraph B.

Sec. 2. 38 MRSA §419-C, sub-§1, ¶C,  as amended by PL 2003, c. 627, §6, is further amended to read:

C. After September 1, 2000, sell or offer for sale in this State any invasive aquatic plant; or

Sec. 3. 38 MRSA §419-C, sub-§1, ¶D,  as enacted by PL 2003, c. 627, §7, is amended to read:

D. Fail to remove any aquatic plant or parts of any aquatic plant, including roots, rhizomes, stems, leaves or seeds, from the outside of a vehicle, boat, personal watercraft, boat trailer or other equipment on a public road . ; or

Sec. 4. 38 MRSA §419-C, sub-§1, ¶E  is enacted to read:

E Use a tank truck to withdraw or transport water from a water body that has a confirmed infestation of an invasive aquatic plant if the withdrawn water is to be used in a pool or pond or for irrigation.

SUMMARY

This bill prohibits the Commissioner of Inland Fisheries and Wildlife from issuing a permit to a bass club to conduct a bass tournament on a water body that has a confirmed infestation of an invasive aquatic plant. The bill also prohibits the use of a tank truck to withdraw or transport water from a water body that has a confirmed infestation of an invasive aquatic plant if the water is to be used in a pool or pond or for irrigation.
