Amend the bill by striking out the title and substituting the following:

‘An Act To Amend the Standards by Which All-terrain Vehicles and Snowmobiles May Be Stopped’

Amend the bill by inserting after section 1 the following:

Sec. 2. 12 MRSA §10353, sub-§2, ¶H,  as enacted by PL 2003, c. 414, Pt. A, §2 and affected by c. 614, §9, is repealed and the following enacted in its place:

H If the warden has reasonable and articulable suspicion to believe that a violation of law has taken place or is taking place, stop and examine any snowmobile to ascertain whether it is being operated in compliance with chapter 937 or any other provision of this Part regulating snowmobiles and demand and inspect the operator's certificate of registration. Other law enforcement officers are subject to the provisions of this paragraph; and

Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

Current law provides that a law enforcement officer may stop a snowmobile without having a reasonable and articulable suspicion that a violation of the law has occurred or is taking place. This amendment requires a law enforcement officer to have a reasonable and articulable suspicion that a violation of the law has occurred or is taking place before stopping a snowmobile.
