Amend the amendment by striking out the substitute title and replacing it with the following:

‘An Act To Ensure that Replacement Culverts Permit Fish Passage’

Amend the amendment by striking out all of Parts A and B.

Amend the amendment in Part C by striking out all of the first line (page 7, line 18 in amendment)

Amend the amendment in Part C by striking out all of sections 1 to 3.

Amend the amendment in Part C in section 4 in paragraph B in the last line (page 7, line 33 in amendment) by striking out the following: " flow" and inserting the following: ' flow. This paragraph applies only to water courses containing fish'

Amend the amendment in Part C in section 5 in subsection 2-A in the last line (page 8, line 8 in amendment) by inserting after the following: " flow." the following: ' This subsection applies only to water courses containing fish.'

Amend the amendment in Part C in section 6 in the 3rd line (page 8, line 11 in amendment) by inserting after the following: "crossings." the following: 'These rule changes apply only to water courses containing fish.'

Amend the amendment in Part C by striking out all of section 7.

Amend the amendment in Part C in section 8 in the 2nd line (page 8, line 27 in amendment) by striking out the following: "Part" and inserting the following: 'Act'

Amend the amendment in Part C by inserting after section 8 the following:

Sec. C-9. Road construction; maintenance. The provisions of this Act do not affect forestry management activities, including associated road construction or maintenance.’

Amend the amendment by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

Summary

This amendment strikes out all of Committee Amendment "A" except the part that amends the exceptions in the Natural Resources Protection Act for the maintenance and repair of stream crossings and of existing road culverts and clarifies that the exceptions apply only to water courses containing fish. Forestry and agricultural activities are exempted from the new standards.
