Amend the bill in section 12 in §6506 by striking out all of subsection 4 (page 5, lines 28 to 36 in L.D.) and inserting the following:

4 Exemptions.   A license is not required to engage in saltwater recreational fishing in coastal waters for:
A An individual under 16 years of age or a resident 70 years of age or older;
B A passenger or crew member on board a vessel captained by an individual who possesses a current guide license for tidewater fishing issued by the Department of Inland Fisheries and Wildlife in accordance with section 12853;
C A passenger or crew member on board a vessel carrying 7 or more for-hire passengers engaged in recreational saltwater fishing;
D An individual renting a smelt fishing camp from a commercial operator;
E An individual who possesses a current tidewater fishing guide license issued in accordance with section 12853; and
F An individual that possesses a valid New Hampshire saltwater recreational fishing license or is registered with that state to recreationally fish in saltwater.

Amend the bill in section 12 in §6506 in subsection 6 in paragraph A in the first line (page 6, line 2 in L.D.) by striking out the following: " Fifteen" and inserting the following: ' Five'

Amend the bill in section 12 in §6506 in subsection 6 in paragraph B in the first line (page 6, line 3 in L.D.) by striking out the following: " Thirty" and inserting the following: ' Fifteen'

Amend the bill in section 12 in §6506 in subsection 6 in paragraph C in the first line (page 6, line 4 in L.D.) by striking out the following: " Fifteen" and inserting the following: ' Eight'

Amend the bill in section 12 in §6506 in subsection 6 in paragraph D in the first line (page 6, line 6 in L.D.) by striking out the following: " Fifteen" and inserting the following: ' Eight'

Amend the bill by inserting at the end before the summary the following:

Sec. 14. Appropriations and allocations. The following appropriations and allocations are made.

Initiative: Provides funding for one 1/2-time Public Service Manager I position, 3 seasonal 1/2-time Marine Patrol Officer positions and related All Other costs to enforce the newly created saltwater recreational fishing license.

Sec. 15. Effective date. This Act takes effect January 1, 2011.’

summary

This amendment is the minority report and reduces the fee for a resident saltwater recreational fishing license from $15 to $5 and reduces the nonresident fee from $30 to $15 for an annual nonresident saltwater recreational fishing license and from $15 to $8 for other saltwater recreational fishing licenses. It provides reciprocity for a person licensed or registered in New Hampshire to recreationally fish in salt water and it provides that the provisions of the bill take effect January 1, 2011. The amendment also adds an appropriations and allocations section.
