An Act To Improve Solid Waste Disposal Quality
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 38 MRSA §1306, sub-§7 is enacted to read:
7. Sorting and testing by solid waste disposal facilities. A solid waste disposal facility may not landfill or incinerate solid waste if the solid waste has not been sorted in accordance with rules adopted by the department. Solid waste may not be transported from a solid waste disposal facility if the solid waste has not been tested in accordance with rules adopted by the department. The department shall adopt rules to implement this subsection. Rules adopted pursuant to this subsection are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

This bill prohibits a solid waste disposal facility from landfilling or incinerating solid waste if the waste has not been sorted in accordance with rules adopted by the Department of Environmental Protection. It also prohibits the transport of solid waste from a solid waste disposal facility if the waste has not been tested in accordance with department rules.
