Resolve, To Adjust Copayment Rules To Ensure Access to Home-based Care Services
Sec. 1. Amend rules. Resolved: That the Department of Health and Human Services shall amend its rules for home-based care copayments by:
1. Defining housing expenses; transportation expenses; life insurance expenses; unreimbursed medical expenses for a spouse only; and allowable personal expenses;
2. Adding housing expenses; transportation expenses; life insurance expenses; unreimbursed medical expenses for a spouse only; and allowable personal expenses to the consumer payment formula;
3. Adding instructions to subtract $30,000 instead of $15,000 from the amount of liquid assets calculated under the consumer payment formula in step (2) (a) and (b) and, if the result is less than zero, use zero; and
4. Striking the section regarding waiver of consumer payment.
SUMMARY
This resolve directs the Department of Health and Human Services to amend its rules for home-based care copayments to eliminate the copayment waiver and simplify the determination of financial eligibility for the home-based care program. The resolve allows for consideration of expenses for housing, transportation, life insurance, allowable personal expenses and a spouse's unreimbursed medical expenses. The resolve also increases allowable household assets to no more than $30,000.
