Amend the bill by striking out the title and substituting the following:

‘Resolve, Concerning the E-9-1-1 Fund and E-9-1-1 Surcharge Collection for Prepaid Wireless Telecommunications Service’

Amend the bill by striking out everything after the title and before the summary and inserting the following:

Sec. 1. Prepaid wireless stakeholder group. Resolved: That the Public Utilities Commission shall form and participate in a stakeholder group to design a method of collecting an E-9-1-1 surcharge on prepaid wireless telecommunications service that is comprehensive, convenient and least burdensome, taking into account the perspectives of prepaid wireless telecommunications service providers, retailers and end users. The stakeholder group must include a representative of the Emergency Services Communication Bureau within the commission and a representative of the Office of the Public Advocate. The commission shall also invite participation by representatives of providers of prepaid wireless telecommunications service, national retail store chains that sell prepaid wireless telecommunications service, local retail businesses that sell prepaid wireless telecommunications service and any other entities the commission believes should be included to ensure adequate and appropriate stakeholder representation; and be it further

Sec. 2. E-9-1-1 fund. Resolved: That the Public Utilities Commission shall develop recommendations regarding the best method of protecting the integrity of the E-9-1-1 fund established under the Maine Revised Statutes, Title 25, section 2927 and of ensuring access to federal grant funds related to the E-9-1-1 system; and be it further

Sec. 3. Report; authority to report out legislation. Resolved: That the Public Utilities Commission shall report to the Joint Standing Committee on Utilities and Energy by January 15, 2010 the results and recommendations of the stakeholder group under section 1 and the recommendations of the commission under section 2. The Joint Standing Committee on Utilities and Energy may report out legislation relating to the subject matter of this resolve to the Second Regular Session of the 124th Legislature.’

This amendment is the minority report of the committee. The amendment replaces the bill with a resolve. The amendment directs the Public Utilities Commission to:

1. Form and participate in a stakeholder group to design a method of collecting an E-9-1-1 surcharge on prepaid wireless telecommunications service that is comprehensive, convenient and least burdensome, taking into account the perspectives of prepaid wireless telecommunications service providers, retailers and end users; and

2. Develop recommendations regarding the best method of protecting the integrity of the E-9-1-1 fund under the Maine Revised Statutes, Title 25, section 2927 and ensuring access to federal grant funds related to the E-9-1-1 system.

The amendment requires the commission to report to the Joint Standing Committee on Utilities and Energy by January 15, 2010 on both of these matters and authorizes the Joint Standing Committee on Utilities and Energy to report out legislation on these matters to the Second Regular Session of the 124th Legislature.
