An Act To Clarify the Qualifications for the Position of State Archivist

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 2 MRSA §6, sub-§4,  as repealed and replaced by PL 2007, c. 695, Pt. A, §5 and affected by §47, is amended to read:

4. Range 88.   The salaries of the following state officials and employees are within salary range 88:
Director, Bureau of Air Quality;
Director, Bureau of Land and Water Quality;
Director, Bureau of Remediation and Waste Management;
Deputy Commissioner, Environmental Protection;
Director, Office of Licensing and Registration;
Administrator, Office of Securities; and
Deputy Chief of the State Police . ; and
State Archivist.

Sec. 2. 2 MRSA §6, sub-§5,  as amended by PL 2005, c. 405, Pt. D, §4, is further amended to read:

5. Range 86.   The salaries of the following state officials and employees are within salary range 86:
Director of Labor Standards;
State Archivist;
Director, Bureau of Geology and Natural Areas;
Executive Director, Maine Land Use Regulation Commission;
Chair, Maine Unemployment Insurance Commission;
Child Welfare Services Ombudsman; and
Director of the Maine Drug Enforcement Agency.

Sec. 3. 5 MRSA §93, first ¶,  as amended by PL 1995, c. 148, §5, is further amended to read:

The Secretary of State shall appoint a State Archivist subject to review by the joint standing committee of the Legislature having jurisdiction over state and local government matters and to confirmation by the Legislature. The State Archivist shall must be chosen without reference to party affiliation and solely on the ground of professional competence to perform the duties of that office. The State Archivist must be qualified by special training or experience in the field of history or archival work. The State Archivist shall hold holds office for a term of 6 years from the date of the appointment , unless removed for cause under the Civil Service Law, and until a successor has been appointed and qualified. The Governor shall fix compensation of for the State Archivist shall be fixed by the Governor within salary range 88.

This bill requires that the State Archivist have specific training and allows the holder of the position to be removed for cause under the Civil Service Law. The bill also fixes compensation for the State Archivist within salary range 88.
