An Act To Allow the Sale and Use of Fuel Containing MTBE in a Vehicle in a Competitive Event
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 38 MRSA §585-I, sub-§2, as enacted by PL 2003, c. 638, §4, is amended to read:
2. Prohibition on sale. Beginning January 1, 2007, a person may not sell, offer for sale, distribute or blend in this State gasoline that contains more than 1/2 of 1% by volume MTBE that is intended for sale to ultimate consumers in this State , except under the provisions of subsection 4.
Sec. 2. 38 MRSA §585-I, sub-§4 is enacted to read:
4. Exception for motor vehicle racing. The provisions of subsection 2 do not apply to gasoline that contains more than 1/2 of 1% by volume MTBE that is sold for or used by a motor vehicle in a race under Title 8, chapter 22, as long as the gasoline containing MTBE is sold and distributed in prepackaged drums, pails or containers.
