Amend the bill by striking out all of section 1 (page 1, lines 2 to 5 in L.D.) and inserting the following:

Sec. 1. 12 MRSA §1803, sub-§1-A  is enacted to read:

1-A Management and operation of Fort Knox State Historic Site.   Notwithstanding subsection 1, paragraph A, shall transfer management and operation of the Fort Knox State Historic Site to an organization exempt from taxation under the United States Internal Revenue Code of 1986, Section 501(c)(3). A contract under which management and operations responsibilities are transferred must be in effect for a period of 2 years. The Fort Knox State Historic Site remains under the ownership of the State and the jurisdiction of the bureau during the time the contract is in effect.

This subsection is repealed May 1, 2012.

Amend the bill in section 2 in the 12th line (page 1, line 17 in L.D.) by inserting after the following: "Site." the following: 'The agreement must specify that 5% of all entrance fees be transferred to the Bureau of Parks and Lands for deposit in the General Fund.'

Amend the bill by striking out all of section 5 (page 2, lines 1 and 2 in L.D.) and inserting the following:

Sec. 5. Retain unfilled positions. For the period that the contract authorized in this Act is in effect, all positions necessary for the State to operate the Fort Knox State Historic Site remain unfilled and unfunded.

Sec. 6. Appropriations and allocations. The following appropriations and allocations are made.

SUMMARY

This amendment is the minority report of the Joint Standing Committee on Agriculture, Conservation and Forestry. It restricts the contract under which management and operations responsibilities are transferred to 2 years in duration, replacing the transfer of responsibilities on May 1, 2012. It also specifies that 5% of all entrance fees go to the General Fund.
