An Act To Strengthen Maine Small Business by Establishing a Preference Percentage for State Contract Bids
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 5 MRSA §1825-B, sub-§15 is enacted to read:
15. Preference for small businesses. Notwithstanding any other provision of law to the contrary, the Director of the Bureau of General Services shall adopt rules establishing a preference percentage of up to 15% for a business:
A. With 50 or fewer employees and gross sales of less than $5,000,000 within the most recent 12 months for which financial records are available;
B. Whose principal place of business is located in the State;
C. That pays a majority of its payroll to residents of the State; and
D. That provides health and retirement benefits to its employees as determined in subsection 11.
Rules adopted pursuant to this subsection are routine technical rules as defined in chapter 375, subchapter 2-A.
