‘ 2. Confidentiality. Except as provided in subsection 3, body mass index data collected pursuant to subsection 1 are confidential and are not subject to disclosure pursuant to Title 1, chapter 13.’

Amend the amendment in section 1 in §6455 by inserting after subsection 1 the following:
Amend the amendment in section 1 in §6455 in subsection 2 in the last line (page 1, line 21 in amendment) by inserting at the end the following: ' Data reported pursuant to this subsection may be reported in the aggregate only and may not identify an individual student.'
Amend the amendment in section 1 in §6455 by renumbering the subsections to read consecutively.
SUMMARY
This amendment provides that body mass index data collected by school administrative units are confidential except that data may be reported in the aggregate only to the Department of Health and Human Services, Maine Center for Disease Control and Prevention. Data reported in this manner may not identify an individual student.
