An Act To Expand Super Pack License Opportunities

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 12 MRSA §11109-A, sub-§1, as enacted by PL 2005, c. 477, §4, is amended to read:

1. Moose lottery chances. A super pack license includes, upon application, 6 chances in the moose lottery under section 11154, subsection 6 , and the super pack licensee is eligible to accumulate points pursuant to section 11154, subsection 8 except that accumulated points may not be eliminated if, in any year, that person fails to purchase a new chance.

Sec. 2. 12 MRSA §11109-A, sub-§2, as repealed and replaced by PL 2007, c. 492, §1, is amended to read:

2. Antlerless deer permit. A super pack license includes:

A. The opportunity to enter an antlerless deer permit lottery pursuant to section 11152 as afforded by a license contained within the super pack license subject to the conditions and restrictions placed on that license; and

B. An antlerless deer permit as provided under section 11152, except that it is valid only for antlerless deer in wildlife management districts in which at least 5,000 3,500 antlerless deer permits are issued. No more than 2.5% of those antlerless deer permits may be in the form of a super pack license. The commissioner shall implement a system for issuing antlerless deer permits under this subsection.

A super pack licensee that receives an antlerless deer permit pursuant to this subsection may take a 2nd deer either antlered or antlerless under that permit.

Sec. 3. 12 MRSA §11109-A, sub-§3, as amended by PL 2007, c. 492, §§2 and 3, is further amended to read:

3. Harvest of 6 deer. Notwithstanding section 11501, a super pack license authorizes the holder to take:

A. One deer during either the regular open firearm season or the regular archery-only season or the special muzzle-loading season in accordance with sections 11401, 11403 and 11404, respectively;

B. One Two deer in accordance with subsection 2 , paragraph B; and

C. Three One antlered deer and 2 antlerless deer during the special archery season in accordance with section 11402, subsection 4.

Sec. 4. 12 MRSA §11154, sub-§8, as enacted by PL 2003, c. 414, Pt. A, §2 and affected by c. 614, §9, is amended to read:

8. Point system for public chance drawing. The department shall adopt rules to allow a person to accumulate one point for each consecutive year that person purchases an application for a moose hunting permit but is not selected to receive a permit. Each point entitles that applicant to one chance in the public chance drawing. A Except as provided in section 11109-A, subsection 1, a person's accumulated points are eliminated if, in any year, that person is selected to receive a permit or that person fails to purchase a new chance. Rules adopted under this subsection are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

summary

This bill provides that a super pack licensee is eligible for moose lottery bonus points and, unlike other license holders, accumulated bonus points are not eliminated if that person fails to purchase a new lottery chance the following year. It also expands the number and type of deer a super pack license holder is eligible to harvest.
