Amend the bill by striking out all of section 2 (page 1, lines 4 to 15 in L.D.)

Amend the bill in section 14 in subsection 5 in the 2nd line (page 4, line 11 in L.D.) by striking out the following: "mentally retarded persons" and inserting the following: ' mentally retarded persons  individuals with developmental disabilities'

Amend the bill by inserting before the summary the following:

Sec. 16. Rulemaking. No later than January 8, 2010, the Department of Education shall submit to the Legislature provisionally adopted rules necessary to implement the requirements of the Maine Revised Statutes, Title 20-A, section 6662, subsection 2 for the 2010-2011 school year. Rules provisionally adopted by the department pursuant to this section must align the standards for food and beverages sold or distributed on school grounds but outside of school meal programs with the nutritional standards established for the total food service program as defined in Department of Education rules Chapter 51.’

Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

summary

This amendment makes the following changes to the bill.

1. It strikes the section of the bill that changed the requirement that the Department of Education adopt major substantive rules to establish standards for food and beverages sold or distributed on school grounds but outside of school meal programs to an optional adoption of routine technical rules.

2. It directs the Department of Education to submit to the Legislature provisionally adopted rules necessary to implement the requirements of the Maine Revised Statutes, Title 20-A, section 6662, subsection 2 for the 2010-2011 school year. Rules provisionally adopted by the department must align the standards for food and beverages sold or distributed on school grounds but outside of school meal programs with the nutritional standards established for the total food service program as defined in Department of Education rules Chapter 51.

3. It changes a reference to "mentally retarded persons" to "individuals with developmental disabilities" in the law pertaining to transitional services for students with disabilities.
