An Act To Reduce Registration Fees for Certain Generators of Biomedical Waste
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 38 MRSA §1319-O, sub-§3, ¶D, as amended by PL 2005, c. 549, §6, is further amended to read:
D. The board may assess licensing and registration fees sufficient to pay for the department's administrative costs in regulating biomedical waste. The board shall adopt rules to assess a one-time registration fee of $50 for generators of less than 10 pounds of biomedical waste per month. The board may not adopt rules to assess an annual registration fee for such generators. A generator registered as producing less than 10 pounds of biomedical waste per month may not be reclassified based on immunizations for annual influenza or mass immunizations for a pandemic. Rules adopted pursuant to this paragraph are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.
