This resolve authorizes John Jorgensen to bring a civil action against the State for damages in connection with actions taken by the Department of Transportation. It authorizes payment of any settlement up to $4,000,000. If the plaintiff is successful, it is assumed that the first $400,000 would come from the Risk Management Self-Insurance Fund. Anything over $400,000 would come from the Highway Fund. The amount and timing of any payment will depend on when the suit is settled and its outcome. The Department of the Attorney General and the Department of Transportation can absorb the additional costs of defending the claim within existing resources. |
