This
amendment adds the unfunded mandate described above. As amended here, the bill would also
continue to have the funded mandate described in the fiscal note for the
committee amendment, which could now be avoided by the new option to
waive. If either of the choices were
mandate-free (they are not), then neither would be a mandate as there would
be a mandate-free way to avoid the otherwise mandated activities. If a viable choice is available there is no
requirement. |
