Amend the bill by inserting after the title and before the enacting clause the following:
‘Emergency preamble. Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and
Whereas, the Uniform Limited Partnership Act of 2007 should be corrected as soon as possible to remove potential ambiguity; and
Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,’
Amend the bill in section 1 in subsection 5 in the last line (page 1, line 6 in L.D.) by striking out the following: " 9" and inserting the following: ' 11'
Amend the bill by inserting after section 2 the following:
‘Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.’
SUMMARY
This amendment adds an emergency preamble and an emergency clause to make the legislation take effect as soon as approved. The bill contains a retroactivity provision making the change to the law apply retroactively to July 1, 2007.
The Maine Revised Statutes, Title 31, former chapter 11 contained the limited partnership laws, and it was repealed by Public Law 2005, chapter 543. This amendment corrects the cross-reference to that repealed chapter.
