Resolve, To Determine Appropriate Buffer Zones for Landfill Construction and Expansion

Sec. 1. Establishment of buffer zones for landfill construction and expansion. Resolved: That the Executive Department, State Planning Office and the Department of Environmental Protection shall adopt rules establishing buffer zones for landfill construction and expansion. These rules must protect the public and nearby property owners from the visual effects, odor and noise of landfills. The State Planning Office and the Department of Environmental Protection shall hold public hearings in conjunction with the development of these rules. Rules adopted pursuant to this section are major substantive rules as defined in the Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A.
