‘Sec. 44. PL 2005, c. 549, §7 is amended to read:
Sec. 7. Report. The Department of Environmental Protection shall prepare a report on funding for cleanup of sites contaminated by hazardous waste, biomedical waste and waste oil. The report must include an assessment of the adequacy of the Maine Hazardous Waste Fund and must be submitted to the joint standing committee of the Legislature having jurisdiction over natural resources matters no later than February 1 15, 2007 2008. The committee may report out submit legislation dealing with the fees for the transport and disposal of hazardous waste to the First Regular Session of the 123rd Legislature.’
Amend the bill by inserting after section 44 the following:
‘Sec. 45. Retroactivity. That section of this Act that amends Public Law 2005, chapter 549, section 7 is retroactive to February 1, 2007.’

This amendment amends the exemption in the site location of development laws and natural resources protection laws to include aquaculture activities regulated by the Department of Marine Resources under the Maine Revised Statutes, Title 12, section 6072-A, 6072-B or 6072-C. The amendment also extends the date by which the Department of Environmental Protection shall report on funding for cleanup of sites contaminated by hazardous waste, biomedical waste and waste oil and authorizes the Joint Standing Committee on Natural Resources to submit legislation dealing with the fees for the transport and disposal of hazardous waste to the 123rd Legislature by February 15, 2008. The amendment also makes the section that amends Public Law 2005, chapter 549, section 7 retroactive to February 1, 2007. The amendment also makes a technical change to the bill.
