Resolve, To Waive the Tort Claims Limitation on Damages Relative to the Traumatic Brain Injury of Lucas Tolliver

Sec. 1. Authorization to waive tort claims limitation on damages. Resolved: That, notwithstanding any statute or common law to the contrary, Lucas Tolliver is authorized to recover the amount of damages that was allocated to the State in a verdict issued October 10, 2006 by a Cumberland County Superior Court jury.

The Treasurer of State shall pay the portion of the damage award amount allocated to the State on final process issued by the Superior Court or, if applicable, the Supreme Judicial Court. Recovery may not exceed $1,000,000, including costs and prejudgment interest.
