An Act To Resolve Unfunded State Mandates
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 5 MRSA §1877-A, sub-§5 is enacted to read:
5. Unfunded state mandates. The commissioner shall develop and maintain a list of unfunded state mandates imposed upon political subdivisions of the State. By January 15th of each first regular session of the Legislature, the commissioner shall submit to the joint standing committee of the Legislature having jurisdiction over appropriations and financial affairs legislation to repeal each state mandate that remains unfunded.

This bill requires the Commissioner of Administrative and Financial Services to maintain a list of unfunded state mandates that have been imposed by act of the Legislature on towns, cities, counties and other units of government. In the same manner that the Secretary of State must submit legislation to repeal inactive boards each first regular session, the commissioner is required to submit legislation to repeal the unfunded state mandates to the joint standing committee of the Legislature having jurisdiction over appropriations and financial affairs each Legislature.
