An Act To Address the Issue of Drive-offs from Service Stations
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 29-A MRSA §2116 is enacted to read:
§ 2116. Theft of motor fuels by driving away
A person commits a civil violation if the person places motor fuel in the person’s vehicle at a retail fuel outlet and leaves the retail fuel outlet without paying for the motor fuel. As used in this section, “retail fuel outlet” means a place at which gasoline or diesel fuel is stored and supplied to the public.
1. Violation. A person who violates this section is subject to a fine of not less than $50 and not more than $500.

This bill creates a new traffic infraction of theft of motor fuel by driving away to prohibit a person from putting motor fuel into the person’s vehicle and then leaving the retail fuel outlet without paying for the motor fuel.
