Resolve, To Regulate Blasting Operators

Sec. 1. The Department of Public Safety, Office of the State Fire Marshal to adopt rules to regulate blasting companies. Resolved: That the Department of Public Safety, Office of the State Fire Marshal shall adopt rules to regulate companies and individuals that conduct blasting operations. The rules must address:

1. Registration for any individual or company that conducts blasting operations;

2. Standards for a certificate of competency required to be issued to a registrant for which the State Fire Marshal determines minimum levels of expertise and knowledge in the field of blasting; and

3. Standards of financial capacity for registrants in case of personal injury or property damage that may occur during a registrant’s blasting operations. These standards may also include bonding.

Rules adopted pursuant to this section are major substantive rules as defined in Title 5, chapter 375, subchapter 2-A.
