An Act To Stabilize the Department of Inland Fisheries and Wildlife's Bureau of Warden Service and Fisheries and Hatcheries Division

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 12 MRSA §10206, sub-§11  is enacted to read:

11 Percentage of fees to support the warden service and hatcheries.   Except as provided in this subsection, $2 of the fee collected for each resident and $4 of the fee collected for each nonresident and alien hunting, fishing or trapping license or permit issued pursuant to section 11109; section 11109-A; section 11151; section 11151-A; section 11153; section 11154, subsections 3 and 6; section 11159; section 12201, subsection 6, paragraphs B and C; section 12260-A; and section 12501, subsection 6 must be deposited into a special nonlapsing account within the department. Seventy-five percent of the funds in the account must be used for the nonpersonal services of the Bureau of Warden Service and 25% of the funds in the account must be used to fund nonpersonal services of the fisheries and hatcheries division. This subsection does not apply to section 11109, subsection 3, paragraphs A and F; section 11154, subsection 6, paragraph A, subparagraph (1); and section 12501, subsection 6, paragraphs D, E and J.

Sec. 2. 12 MRSA §11109, sub-§3,  as amended by PL 2007, c. 168, §§2 and 3 and affected by §8 and amended by c. 203, §§7 to 9, is further amended to read:

3. Hunting licenses; combination licenses; fees.   Hunting licenses, combination licenses and fees are as follows.
A. A resident junior hunting license, for a person 10 years of age or older and under 16 years of age, is $7.
B. A resident hunting license, for a person 16 years of age or older, is $21 $23.
C. A resident small game hunting license, for a person 16 years of age or older, which permits hunting for all legal species except deer, bear, turkey, moose, raccoon and bobcat, is $14 $16.
D. A resident combination hunting and fishing license is $38 $40.
E. A resident combination archery hunting and fishing license is $38 $40.
E-1. A resident apprenticeship hunter license, which includes a bear hunting permit and a wild turkey hunting permit under sections 11151 and 11155 respectively, is $21 $23.
F. A nonresident junior hunting license, for a person 10 years of age or older and under 16 years of age, is $27.
G. A nonresident small game hunting license, which permits hunting of all legal species except deer, bear, turkey, moose, raccoon and bobcat, is $67 $71.
H. A nonresident 3-day small game hunting license, valid for 3 consecutive hunting days, which permits hunting of all legal species except deer, bear, turkey, moose, raccoon and bobcat for the 72-hour period specified on the license, is $42 $46.
I. A nonresident big game hunting license, which permits hunting of all legal species subject to the permit requirements in chapter 915, subchapter 3, is $102 $106.
J. A nonresident combination hunting and fishing license is $137 $141.
K. An alien small game hunting license, which permits hunting of all species except deer, bear, turkey, moose, raccoon and bobcat, is $72 $76.
L. An alien big game hunting license, which permits hunting of all legal species subject to the permit requirements in chapter 915, subchapter 3, is $127 $131.
M. An alien combination hunting and fishing license is $178 $182.
N. A license to use leashed dogs to track wounded animals, which permits a person to use one or more leashed dogs to track a lawfully wounded deer, moose or bear, is $27 $29.
O. A nonresident small game apprenticeship hunter license, which permits the hunting of all legal species except deer, bear, turkey, moose, raccoon and bobcat, is $67 $71.
P. A nonresident big game apprenticeship hunter license, which permits the hunting of all legal species and includes a bear hunting permit and a wild turkey hunting permit under sections 11151 and 11155 respectively, is $102 $106.

Sec. 3. 12 MRSA §11109, sub-§5,  as amended by PL 2005, c. 397, Pt. E, §7, is further amended to read:

5. Muzzle-loading permits and fees.   Muzzle-loading hunting permits and fees are as follows:
A. A resident muzzle-loading hunting permit is $13 $15;
B. A nonresident muzzle-loading hunting permit is $62 $66; and
C. An alien muzzle-loading hunting permit is $72 $76.

Sec. 4. 12 MRSA §11109, sub-§7,  as amended by PL 2005, c. 12, Pt. III, §5, is further amended to read:

7. Archery hunting licenses; combination licenses; fees.   Archery hunting licenses, combination licenses and fees are as follows:
A. A resident archery license is $21 $23;
B. A resident combination archery hunting and fishing license is $38 $40;
C. A nonresident archery license is $62 $66; and
D. An alien archery license is $72 $76.

Sec. 5. 12 MRSA §11109, sub-§9,  as enacted by PL 2005, c. 419, §5 and affected by §12, is amended to read:

9. Crossbow licenses and fees.   Crossbow hunting licenses and fees are as follows:
A. A resident crossbow hunting license is $25 $27;
B. A nonresident crossbow hunting license is $48 $52; and
C. An alien crossbow hunting license is $72 $76.

Sec. 6. 12 MRSA §11109-A, sub-§5,  as enacted by PL 2005, c. 477, §4, is amended to read:

5. Fee.   The fee for a super pack license is $200 $202 for residents and $175 $177 for a person holding 2 or more lifetime licenses.

Sec. 7. 12 MRSA §11151, sub-§3,  as amended by PL 2005, c. 12, Pt. III, §7, is further amended to read:

3. Issuance; permit fee.   The commissioner, through the commissioner's authorized agent, shall issue a bear hunting permit to an eligible person. The annual fee for each permit issued is $27 $29 for residents and $67 $71 for nonresidents.

Sec. 8. 12 MRSA §11151-A, sub-§3,  as enacted by PL 2007, c. 168, §4 and affected by §8, is amended to read:

3. Issuance; permit fee.   The commissioner, through the commissioner's authorized agent, shall issue a nonresident late season bear hunting permit to an eligible person. The annual fee for each permit issued is $40 $44.

Sec. 9. 12 MRSA §11153, sub-§1,  as amended by PL 2005, c. 12, Pt. III, §8, is further amended to read:

1. Special season deer hunting permits; authority to issue for special season.   The commissioner may implement a permit system to regulate hunter participation in a special season established by the commissioner pursuant to section 11402, subsection 4, paragraph B and the number, sex and age of deer harvested. If permits are issued, the fee for a deer permit other than an antlerless deer permit is $32 $34 and the fee for an antlerless deer permit is $12 $14.

Sec. 10. 12 MRSA §11154, sub-§3,  as amended by PL 2005, c. 12, Pt. III, §9, is further amended to read:

3. Moose hunting permit fee.   The fee for a moose hunting permit is $52 $54 for a resident and $477 $481 for a nonresident or alien.

Sec. 11. 12 MRSA §11154, sub-§6,  as amended by PL 2005, c. 12, Pt. III, §10, is further amended to read:

6. Application procedure.   An eligible person wishing to apply for a permit must file a written application for a permit on a form furnished by the commissioner. The application fee is nonrefundable. A person may file no more than one application. A person who submits more than one application is disqualified from the selection of permittees. The application must be accompanied by an application fee of:
A. For a resident:

(1) Seven dollars for a one-chance application;

(2) Twelve Fourteen dollars for a 3-chance application. A resident must possess a valid big game hunting license to be eligible to purchase a 3-chance application; and

(3) Twenty-two Twenty-four dollars for a 6-chance application. A resident must possess a valid big game hunting license to be eligible to purchase a 6-chance application; or

B. For a nonresident:

(1) Fifteen Nineteen dollars for a one-chance application;

(2) Twenty-five Twenty-nine dollars for a 3-chance application;

(3) Thirty-five Thirty-nine dollars for a 6-chance application; and

(4) Fifty-five Fifty-nine dollars for a 10-chance application; multiple 10-chance options may be purchased.

Sec. 12. 12 MRSA §12201, sub-§6,  as amended by PL 2005, c. 12, Pt. III, §23, is further amended to read:

6. Trapping fees.   The fees for trapping licenses are as follows:
A. A resident junior trapping license, for a person 10 years of age or older and under 16 years of age, is $9;
B. A resident trapping license, for a person 16 years of age or older, is $35 $37; and
C. A nonresident trapping license is $310 $314.

Sec. 13. 12 MRSA §12260-A, sub-§3,  as enacted by PL 2007, c. 168, §7 and affected by §8, is amended to read:

3. Issuance; permit fee.   The commissioner, through the commissioner's authorized agent, shall issue a bear trapping permit to an eligible person. The annual fee for each permit issued is $27 $29 for residents and $67 $71 for nonresidents.

Sec. 14. 12 MRSA §12501, sub-§6,  as amended by PL 2005, c. 12, Pt. III, §24, is further amended to read:

6. Schedule of fees.   The fees for fishing licenses are as follows.
A. A resident fishing license is $21 $23.
B. A resident combination hunting and fishing license is $38 $40.
C. A resident combination archery hunting and fishing license is $38 $40.
D. A nonresident junior fishing license, for persons 12 years of age or older and under 16 years of age, is $9.
E. A 3-day fishing license for a resident or nonresident, valid for the 72-hour period specified on the license, is $23.
F. A nonresident 7-day fishing license, valid for 7 days from date indicated on license, is $36 $40.
G. A nonresident 15-day fishing license, valid for 15 days from date indicated on license, is $40 $44.
H. A nonresident season fishing license for persons 16 years of age or older is $52 $56.
I. An alien season fishing license for persons 16 years of age or older is $72 $76.
J. A one-day fishing license for a resident or nonresident, valid for the 24-hour period indicated on license, is $11.

summary

This bill raises certain hunting, fishing and trapping licensing and permit fees by $2 for residents and $4 for nonresidents. It provides that revenue raised by the fee increases must be deposited into a special nonlapsing account within the Department of Inland Fisheries and Wildlife to fund nonpersonal services of the Bureau of Warden Service and the fisheries and hatcheries division in amounts equal to 75% and 25%, respectively.
