Amend the bill in section 3 in §565-A in subsection 4 in the 3rd to 6th lines (page 3, lines 17 to 20 in L.D.) by striking out the following: " or provide the tank owner or operator with a red tag for that purpose. Immediately upon receipt of a red tag from the department, the owner or operator shall affix the tag, in plain view, to the tank fill pipe"

This amendment requires a threat of release to be imminent in order for the Commissioner of Environmental Protection to issue an administrative order to cease operation of an underground oil storage tank.
