An Act To Provide for Enforcement of the Office Paper Recycling Program
Sec. 1. 38 MRSA §2138, sub-§1, as amended by PL 1995, c. 656, Pt. A, §41, is further amended to read:
The office may provide technical and marketing assistance and direction to entities within the State to assist with meeting this requirement. Municipalities and regional associations may assist employers in attaining the objectives of this section.
The department shall adopt major substantive rules, pursuant to Title 5, chapter 375, subchapter 2-A, to enforce the provisions of this subsection. The rules must include civil penalties as provided in section 349, subsection 2.

Current law requires an employer of 15 or more people to implement an office paper and corrugated cardboard recycling program.
This bill specifies that the Department of Environmental Protection is responsible for enforcement of the recycling program and requires the department to adopt rules regarding enforcement, including civil penalties.
