Resolve, To Modify the 2007 Elver Fishing Season
Emergency preamble. Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and
Whereas, the elver season closes May 31, 2007; and
Whereas, the elver season has been devastated by late winter storms causing severe economic loss to fishermen, buyers and communities; and
Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore, be it
Sec. 1. Modify season. Resolved: That, notwithstanding the Maine Revised Statutes, Title 12, section 6575-A, a person may fish for or take elvers within the waters of the State every day of the week, including from noon Friday to noon Sunday, during the 2007 season only.
Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.
